Russian state buyers to lose loophole for importing Western electronics without local analogs

The Ministry of Industry and Trade has drafted a resolution that would close a loophole allowing state buyers to purchase Western electronics while bypassing import substitution requirements. The new rules are set to take effect on January 1, 2027. Currently, buyers combine in a single tender lot both devices that have Russian analogs and those that do not. Formally, the "second extra" rule is observed, but in practice foreign equipment is procured across all positions.

More than 70% of Russian companies in radio electronics and computing have complained that state buyers systematically circumvent the requirement to prioritize domestic products. The updated version of Government Resolution No. 1875 of December 23, 2024, would prohibit mixing in one lot equipment with existing Russian analogs and items lacking such analogs.

The restriction will cover a wide range of devices. First of all, it applies to mobile computers weighing up to 10 kg — all modern laptops, tablet and handheld computers. The ban also extends to monitors, projectors, laser and inkjet multifunction devices that combine a printer, scanner and fax in a single housing. Changes will affect peripherals such as mice and keyboards, as well as electronic computing machines supplied as automatic data processing systems.

State buyers currently use this scheme extensively to avoid switching to products from domestic manufacturers. Adding at least one item without a Russian analog to a lot makes the "second extra" rule inapplicable to the entire lot. This allows them to legally procure foreign brands, including Apple equipment, instead of supporting local suppliers.

The initiative comes from the Ministry of Industry and Trade, which has already prepared the draft resolution. If adopted, the new rules will come into force at the beginning of 2027.
